HYPERSPY sells analytical software and alerts, not financial advice. We are not your adviser or broker. Trading can lose you money and every decision is yours. Past or hypothetical results do not predict future results. Our service is provided as is, our liability is limited to what you paid us, and disputes are resolved by individual arbitration in Florida. The full terms below control.
Terms of Service
An agreement between you and HYPERSPY LLC ("HYPERSPY", "we", "us").
1. Acceptance
By creating an account, subscribing, accessing our indicators or alerts, or using this website (together, the "Service"), you agree to these Terms, the Risk Disclosure, the Privacy Policy, the Subscription & Refund Policy and the Trading & Conflicts Policy. If you do not agree, do not use the Service. You must be at least 18 years old and legally able to enter into contracts.
2. What the Service is
The Service consists of software indicators that run on third-party charting platforms such as TradingView, automated alerts generated by that software, and related educational content. All content is provided for educational and informational purposes only.
3. No investment advice; no adviser relationship
HYPERSPY is not a registered investment adviser, broker-dealer, commodity trading advisor or financial planner. Nothing in the Service is a recommendation or solicitation to buy, sell or hold any security or financial instrument, or advice that is suitable for you. Our alerts are impersonal: every subscriber receives the same output generated by the same software, without regard to anyone's financial situation, objectives or risk tolerance. We do not provide individualized advice through any channel, including email, social media or chat. Using the Service does not create an advisory, fiduciary or broker relationship.
4. Your responsibility
You are solely responsible for your own trading and investment decisions, for evaluating the merits and risks of any trade, and for complying with the laws that apply to you. You should consult a licensed financial professional before making investment decisions. You acknowledge that you have read and understood the Risk Disclosure.
5. License
Subject to these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the indicators on your own account for your own use during your subscription. You may not share, resell, sublicense, copy, decompile, reverse-engineer, screenshot-and-redistribute alert content commercially, or attempt to access the source code of any protected or invite-only script. Access is tied to one TradingView username unless we agree otherwise in writing. All intellectual property in the Service, including the HYPERSPY name and logos, belongs to HYPERSPY LLC.
6. Third-party platforms and data
The Service depends on platforms, data feeds and networks we do not control, including TradingView, exchanges, data vendors, email and webhook providers. We are not responsible for their availability, accuracy, delays, outages or changes. Market data may be delayed, incomplete or adjusted.
7. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, non-infringement and uninterrupted or error-free operation. We do not warrant that any signal, alert, forecast or result will be accurate, profitable, timely or delivered at all.
8. Limitation of liability
To the maximum extent permitted by law, HYPERSPY LLC and its members, managers, employees and agents will not be liable for any trading or investment losses, lost profits, or indirect, incidental, special, consequential, exemplary or punitive damages arising from or related to the Service, even if advised of the possibility of such damages. Our total liability for all claims relating to the Service will not exceed the greater of the fees you paid us in the twelve (12) months before the claim arose or one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
9. Indemnification
You agree to defend, indemnify and hold harmless HYPERSPY LLC and its members, managers, employees and agents from any claims, losses, damages and expenses (including reasonable attorneys' fees) arising from your use of the Service, your trading, your violation of these Terms, or your violation of any law or third-party right.
10. Dispute resolution: individual arbitration and class-action waiver
Please read carefully. This section affects your legal rights.
Except for small-claims matters and claims for injunctive relief to protect intellectual property, any dispute arising from or relating to the Service or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Miami-Dade County, Florida. Before filing, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for 30 days.
You and HYPERSPY each waive the right to a jury trial and the right to participate in a class action, class arbitration or representative proceeding. Claims may be brought only in an individual capacity.
You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms, with your name and the statement that you opt out of arbitration.
11. Governing law and venue
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Any matter not subject to arbitration will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.
12. Suspension and termination
We may suspend or terminate your access at any time if you breach these Terms, share or resell access, abuse the Service, or if required by law. Sections 3, 4, 5 (restrictions), 7, 8, 9, 10 and 11 survive termination.
13. Changes
We may update these Terms. Material changes will be posted on this page with a new effective date and, for subscribers, sent by email. Continued use after changes take effect means you accept them.
14. General
These Terms are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
Risk Disclosure
Read this before using any HYPERSPY tool.
Trading involves substantial risk
Trading and investing in stocks, exchange-traded funds such as SPY, and options involves substantial risk of loss and is not suitable for every person. You can lose some or all of the money you invest. Options and margin can cause losses greater than your initial investment. Only trade with money you can afford to lose.
No guarantee of results
No indicator, model or alert can predict the market reliably. Signals can be wrong, late, missing or contradictory. Market conditions change, and a method that worked in the past may stop working. Past performance, whether actual or hypothetical, is not indicative of future results.
Hypothetical and simulated performance
Hypothetical or simulated performance results have certain inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. Because the trades have not actually been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity, slippage, commissions and fees. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.
Backtests are limited by the data available. A test covering a short period, or a period without a bear market, may not reflect how a method behaves in other conditions. Charts and animations on our website are illustrative simulations and are not records of actual trades.
Execution and technology risk
Alerts depend on TradingView, data vendors, the internet, email and webhook services. They may be delayed, duplicated or not delivered. Prices at which you can actually trade may differ from prices shown in alerts. Automating trades from alerts (for example with webhooks or third-party bots) is entirely at your own risk; we do not operate, endorse or support any automated execution of your account.
Your decisions
You are solely responsible for every trade you place. Consider your financial situation, objectives and experience, and consult a licensed professional before trading.
Privacy Policy
What we collect, why, and your choices.
What we collect
- Information you give us: your email address (for example when you join the waitlist, together with the date and time you joined and your approximate country), your name, your TradingView username for script access, and messages you send us.
- Payment information: processed by our third-party payment processor. We do not store full card numbers.
- Technical information: basic data such as browser type, device and pages visited, collected by our hosting provider for security and performance, and privacy-friendly visit statistics (Cloudflare Web Analytics) that do not use cookies.
How we use it
To provide and manage your access, process payments, send service and account messages, send updates you've asked for, prevent fraud and abuse, and comply with the law.
Sharing
We do not sell your personal information. We share it only with service providers that help us run the Service (for example hosting, email, payment processing and TradingView access management), when required by law, or as part of a business transfer.
Your choices
You can unsubscribe from marketing emails at any time with the link in the email or by writing to us. You can ask us to access, correct or delete your personal information by emailing [email protected]. We keep information only as long as needed for the purposes above and our legal obligations.
Security and children
We use reasonable safeguards, but no system is perfectly secure. The Service is not intended for anyone under 18, and we do not knowingly collect their information.
Subscription & Refund Policy
How billing, renewal and cancellation work.
Automatic renewal
Subscriptions renew automatically at the end of each billing period at the price shown when you subscribed, until you cancel. Before you subscribe we show you the price, the billing period and the fact that it renews automatically, and we ask for your express consent. We will notify you in advance of any price change.
Cancel anytime
You can cancel at any time from your account or by emailing [email protected]. Cancellation stops future renewals; you keep access until the end of the period you already paid for.
Refunds
7-day guarantee for new subscribers. If you are a first-time subscriber, you may request a full refund of your first payment within 7 days of that payment by emailing [email protected]. The guarantee applies once per person.
After those 7 days, and for all renewal payments, fees are non-refundable, including for partial billing periods and unused time, except where a refund is required by law. Refunds are issued to the original payment method.
Access removal
When a subscription ends, is refunded or is terminated for breach, access to invite-only scripts and alerts is removed.
Trading & Conflicts Policy
How we handle our own trading.
- HYPERSPY LLC and its principals trade for their own accounts, and may hold, buy or sell SPY and related instruments, including positions that differ from a current alert.
- We never trade ahead of an alert we send to subscribers, and we never trade against an alert to profit from subscribers' reactions to it.
- We do not accept compensation from any issuer, broker or third party to promote a security.
- We never manage, custody or trade subscriber funds or accounts.
